Jan. 9, Ms. Yu, a citizen of Jinan, reported to the party newspaper hotline that she bought a pair of Nike shoes a few months ago, and after wearing them for about half a month, she found that one of the shoes had cracked at the connection between the upper and sole. After testing, the Nike merchant admitted that the shoes had quality problems. The Nike counter said it could not find a basis for 10 times compensation, so it was only for the lady to return or replace the shoes.
Ms. Yu told the party newspaper hotline that several months ago she bought a pair of Nike sneakers at the Nike counter in Harmony Square, Ginza Mall. After wearing them for about half a month, her son found that one of the shoes had cracked at the connection between the upper and sole. After testing, the Nike merchant admitted that the shoes had quality problems. The Nike counter said it could not find a basis for 10 times compensation, so it was only for the lady to return or replace the shoes.
According to Ms. Yu, on October 2 last year, she bought a pair of more than 300 pairs of Nike sneakers for her son at the Nike counter in Harmony Square store in Ginza Mall. One day in December, she found that the connection between the upper and sole of one of the shoes had split. The son went to school in Zhangqiu and only wore them for a few days after returning home. So, according to rough statistics, the shoes were worn for about half a month. She then reflected that to the Nike counter. Nike counters say they can either return the shoes or replace them at a higher price. Ms. Yu refused. She believed that Nike, as a famous brand product, should give consumers a statement after quality problems occur, rather than simply exchange it.
Another week later, Ms. Yu received a phone call from the store again. The other side said that she had done the quality inspection of the shoes and admitted that there was a quality problem in the Nike shoes, but the treatment was still refund or change. Ms. Yu said that she had seen a consumer on TV asking the store to pay 10 times the cost of meals for eating worms in Aqua Ramen, so she also asked the Nike counter to pay 10 times the price of shoes as compensation.
Ms. Yu provided a "Leather Product Complaint Handling List" issued by Jinan Quality Supervision and Inspection Institute and Jinan Consumer Association Leather Product Complaint Center. The "Handling List" wrote in the column of appraisal results and complaint handling opinions: "The foot of the shoe cracked during the three-pack period. After appearance inspection, the phenomenon belongs to the performance failure in the three-pack regulation."
Ms. Sun, head of Nike counter in Harmony Square Shop of Ginza Mall, explained to reporters by telephone that, after testing, the Nike shoes that Ms. Yu had purchased at the outset did have quality problems, but according to the relevant provisions of the three-package law, sports goods did not have the "one false for ten" provisions, so they could not meet the 10 times compensation requirements put forward by the ladies. What we can do now is for women to return this pair of Nike shoes or replace a new pair. If there is a price difference in the process of changing shoes, women can enjoy a certain discount. They have consulted 12315 hotline before, and the other side's suggestion for dealing with this problem is to replace shoes for consumers. In addition, Ms. Yu's 10-fold claim for compensation was also reported to her superior, Nike's agency in Jinan, but was not granted.
Subsequently, Ms. Liu, a sports commodity manager in Harmony Plaza Store in Ginza, contacted the newspaper, saying that the products sold by Nike counters had been tested at the beginning and could not be fake, so they could not meet the consumer's demand of "one false, ten compensations". At present, the cracking may be due to the quality problems caused by the material quality, wearing methods and so on. In this regard, the Consumer Association Department of our city also requires the stores to deal with the three packages of footwear commodities in accordance with the provisions, according to which a similar problem is the return and exchange of goods. They will then communicate with consumers and make appropriate compensation after returning and exchanging goods.
